1. What this covers

These terms apply to this website (zarden.app) and, when it ships, the Zarden iPhone app, published by Nicolas Carrion (Nyko Labs). Using either means you accept them.

2. The service

Zarden is an entertainment app built around sleep. It reads sleep data already on your device, with your permission, and turns it into a garden game.

Zarden is not a medical device. It does not diagnose, treat, or give medical advice. Duration, quality and regularity are game elements, computed from consumer-device measurements that are neither guaranteed nor certified. They must not be used to make a health decision. If you have a persistent sleep problem, talk to a clinician.

3. Access

The site is free. It does not collect an email. When a pre-order or download is live, that happens on the App Store. The app is not available yet. When it is, it will require a compatible iPhone; automatic sleep sync needs data already in Apple Health. Your connectivity and device costs are yours.

4. Age

You must be at least 13. If you are a minor, you need permission from the person with parental authority.

5. Your data

Garden and sleep data live on your device. We cannot restore a garden after uninstall, loss, or a broken phone. Optional rewarded videos are served by Google AdMob; that partner may receive advertising identifiers, not your nights. See the privacy policy.

6. Acceptable use

You agree not to reverse-engineer the app except as the law allows; not to tamper with game data to fake progress; not to use the service unlawfully; and not to scrape the site for commercial reuse without permission.

7. Intellectual property

We grant a personal, non-exclusive, non-transferable, revocable licence to use the app for private, non-commercial use. Nothing here transfers ownership. If the app is obtained from the App Store, Apple’s licensed application end-user terms also apply and prevail on the points they cover.

8. Availability

The service is provided as-is. We may change, suspend, or stop all or part of it. Game mechanics and content may change in updates.

9. Liability

We are not liable for the accuracy of sleep data supplied by your device or other apps; for lost progress after uninstall, loss, or failure of your device; or for indirect damage. Nothing here limits liability where the law forbids it (including fraud, gross negligence, or bodily harm).

10. Changes

The version on this page when you use the service is the one that applies. Material changes will be noted here.

11. Law

These terms are governed by French law. Consumers keep the right to sue in their place of residence.
